1.Introduction

Divana Wellness Co., Ltd. and Divana Global Co., Ltd., together with affiliated companies operating under the “Divana” brand (collectively, the “Company”, “we”, or “Divana Wellness”), place great importance on protecting the personal data of our customers, guests, members, website and application visitors, and any other individuals connected with our business (collectively, “you”).

This Privacy Policy explains how we collect, use, and disclose your personal data, whether through our website, application, other online channels, or when you visit us in person at one of our spa locations, in accordance with the Personal Data Protection Act B.E. 2562 (2019) (“PDPA”) and other applicable laws.

Please read this Policy carefully so that you understand the purposes for which we collect, use, or disclose your personal data, as well as your rights as a data subject.

2.Definitions

  • “Personal Data” means any information relating to a natural person which enables the identification of that person, whether directly or indirectly, excluding the data of deceased persons.
  • “Processing” means the collection, use, or disclosure of personal data.
  • “Data Subject” means you, as the natural person who can be identified by the personal data.
  • “Data Controller” means the Company, which has the authority to decide on the collection, use, or disclosure of personal data.
  • “Cookies” means small data files stored on your device when you visit the Company’s website.

We collect your personal data through both online channels (website, application, online booking systems, social media) and in-store/spa channels, as set out below.

The Company does not, as a matter of policy, collect health records, medical history, or other sensitive personal data under Section 26 of the PDPA for the purpose of ordinary service delivery, unless you voluntarily provide such information to us. In any such case, we will obtain your explicit consent before collecting it.

4.Sources of Personal Data

  • Data you provide directly, such as through booking forms, membership registration, or enquiries made through our various channels.
  • Data collected automatically through our website and application, such as cookies and log files.
  • Data from third parties, such as booking platforms, distributors, or business partners, where you have consented to the disclosure of your data to us.
  • Image data captured by CCTV when you visit our premises.

6.Disclosure of Personal Data to Third Parties

We may disclose or transfer your personal data to the following categories of recipients, only to the extent necessary and for the purposes set out in this Policy.

  • Third-party service providers engaged by the Company, such as online booking system providers, payment service providers, cloud storage providers, and marketing service providers.
  • Affiliated companies or business partners, only where necessary to deliver services or where you have given consent.
  • Government agencies, regulators, or other authorities, where required by law or court order.
  • Auditors, legal advisors, or other professional advisors of the Company, to the extent necessary.

We require any third party that receives personal data from us to maintain appropriate data security measures and to process the data only within the scope we have authorised.

7.Cross-Border Transfer of Personal Data

Where the Company needs to send or transfer your personal data to a service provider or entity located outside Thailand (for example, an international cloud service provider), we will ensure that the destination country has an adequate standard of data protection as required under the PDPA, or that appropriate safeguards are in place, such as entering into a Data Processing Agreement with the data recipient.

8.Data Retention Period

We retain your personal data only for as long as necessary to fulfil the purposes described in this Policy, having regard to the following criteria.

  • Transaction and accounting records are retained for no less than 5 years, as required under applicable accounting and tax laws.
  • Membership and marketing data is retained for as long as you remain a member or have given consent, and will be deleted or anonymised within a reasonable period after you withdraw consent or your membership ends.
  • CCTV footage is retained for no more than 30 days, unless required for longer as evidence in connection with a dispute or incident.

Once the retention period has expired, we will delete, destroy, or anonymise your personal data in accordance with appropriate security standards.

9.Data Security Measures

We have implemented appropriate technical and organisational security measures to prevent the loss, unauthorised or unlawful access to, destruction, use, alteration, or disclosure of personal data. These measures include, but are not limited to:

  • Restricting access to personal data to employees or persons who need it on a need-to-know basis.
  • Encrypting sensitive or financial data.
  • Training employees and building awareness of personal data protection.
  • Regularly reviewing and updating our security measures in line with relevant standards.

10.Your Rights as a Data Subject

Under the PDPA, you have the following rights as a data subject, subject to applicable legal limitations.

  • The right to withdraw consent, where processing is based on consent.
  • The right to access and obtain a copy of your personal data.
  • The right to data portability.
  • The right to object to the collection, use, or disclosure of your personal data.
  • The right to erasure or anonymisation of your personal data.
  • The right to restrict the processing of your personal data.
  • The right to rectify inaccurate or outdated personal data.
  • The right to lodge a complaint with the Personal Data Protection Committee if the Company fails to comply with the PDPA.

11.Cookies Policy

Our website and application use cookies and similar technologies to remember your preferences, improve your experience, analyse usage behaviour, and present content or advertising relevant to your interests. We use the following categories of cookies:

  • Analytics cookies, used to analyse website usage behaviour.

12.CCTV Policy

To protect the safety of our customers, staff, and visitors, we have installed CCTV cameras in common areas of our premises, such as entrances/exits, reception counters, and other public areas within our branches.

  • We do not install CCTV cameras in areas that would infringe on your privacy, such as private treatment rooms, restrooms, or changing rooms.
  • Footage is used solely for security purposes and will only be disclosed to third parties where legally required or requested by an authorised agency.
  • We display clear signage in areas where CCTV cameras are installed.
  • Footage is retained in accordance with the retention period set out under “Data Retention Period” above.

13.Personal Data of Minors

Our services are intended for individuals who have reached the age of majority. We do not intend to collect personal data of minors without the consent of a parent or legal guardian, as required by law. If we become aware that we have collected a minor’s personal data without valid consent, we will delete such data as soon as possible.
